These Buyer Terms govern the use of buyer functions on the KOTLYARS international marketplace and auction platform, including fixed-price purchases and participation in online auctions. By purchasing an item or placing a bid, users agree to comply with these Terms and all applicable platform policies.
Buying through KOTLYARS requires responsible conduct, careful review of listings, compliance with applicable laws, and respect for the rights of sellers and other marketplace participants.
These Terms supplement the general Terms and Conditions, Auction Rules, Privacy Policy, Buyer Guide, Returns and Refunds Policy, and other applicable KOTLYARS policies. Where mandatory law applies, the relevant legal requirements prevail.
- Application of These Terms. These Buyer Terms apply to all purchases, bids, offers, and buyer-related activities on the KOTLYARS platform. By using buyer functions, confirming a purchase, or placing a bid, the user accepts these Terms.
- Account Eligibility. Buyers must have the legal capacity required to enter into binding transactions and must provide accurate registration information. Buyers are responsible for maintaining account security and for all activity carried out through their account. KOTLYARS may request identity verification for particular categories, high-value items, or unusual activity.
- Seller Status and Contracting Party. Listings may be offered by either private individuals or professional traders. Seller status is based on information provided by the seller and should be reviewed before completing a transaction. Unless expressly stated otherwise, the sales contract is concluded directly between the buyer and the seller. Consumer rights may vary depending on seller status and applicable law.
- Item Information and Due Diligence. Buyers should carefully examine the item description, photographs, specifications, condition, provenance, certificates, delivery terms, and return policy before purchasing. KOTLYARS does not automatically verify the authenticity, quality, legality, or value of listed items. Independent expert assessment is recommended for gemstones, jewellery, artwork, collectibles, and other high-value property.
- Fixed-Price Purchases. Before making payment, buyers should confirm with the seller the exact item, purchase price, currency, payment method, delivery arrangements, insurance, and return conditions. A purchase confirmation or clear intention to buy may create a legally binding obligation under the listing terms, the parties' agreement, and applicable law.
- Auction Participation. Buyers must review the Auction Rules, lot description, reserve price, bidding increments, auction closing time, and any applicable fees before bidding. A bid constitutes an offer to purchase and may become legally binding. Buyers must not manipulate bidding, submit bids without intent to pay, or withdraw bids except where permitted by law or platform rules.
- Price, Fees and Taxes. Before buying or bidding, buyers should verify the total purchase price, currency, shipping charges, insurance costs, customs duties, taxes, and any additional fees. Platform fees or buyer premiums apply only where clearly disclosed before the purchase or bid. Buyers remain responsible for taxes and statutory charges imposed upon them.
- Payment. KOTLYARS does not currently receive, process, or hold marketplace payments. Payments are made directly between buyer and seller under mutually agreed terms. Buyers should verify recipient details carefully, use traceable payment methods, and retain payment records. KOTLYARS is not responsible for funds sent to incorrect or fraudulent payment details except where required by applicable law.
- Delivery, Insurance and Customs. Buyers and sellers should agree in advance on shipping methods, delivery schedules, packaging standards, insurance coverage, and responsibility for associated costs. Ownership transfer and risk allocation are determined by the parties' agreement and applicable law. Buyers remain responsible for import restrictions, customs duties, taxes, and legal compliance within the destination jurisdiction.
- Inspection and Notice. Buyers should inspect purchased items promptly after delivery while retaining packaging, documentation, and evidence of condition. Damage, material discrepancies, missing components, or suspected counterfeit items should be reported immediately to both the seller and KOTLYARS. Items should not be repaired, modified, or altered while a dispute remains under review.
- Cancellation, Returns and Refunds. Cancellation rights, returns, and refunds depend on seller status, listing terms, the Returns and Refunds Policy, and applicable law. Transactions with private individuals may not provide the same mandatory consumer protections as purchases from professional traders. Nothing in these Terms limits consumer rights that cannot legally be waived.
- Prohibited Buyer Conduct. Buyers must not provide false information, misuse another person's account, manipulate auctions, engage in fraud, abuse return procedures, interfere with platform operations, circumvent restrictions, or attempt to purchase prohibited or illegal goods.
- Legal and Trade Compliance. Buyers must comply with all applicable laws relating to imports, exports, sanctions, customs, restricted goods, and international trade. KOTLYARS may request supporting documentation, restrict transactions, suspend accounts, or cooperate with competent authorities where required by law or reasonably necessary to prevent legal violations.
- Role of KOTLYARS and Disputes. KOTLYARS provides a digital marketplace connecting buyers and sellers. Unless expressly stated otherwise, KOTLYARS is not the seller, payment provider, carrier, insurer, appraiser, or contracting party. Buyers and sellers should first seek to resolve disputes directly. KOTLYARS may facilitate communication or review alleged rule violations but is not obligated to issue legally binding decisions.
- Account Restrictions, Updates and Contact. KOTLYARS may restrict platform functions, suspend or terminate buyer accounts, cancel bids or transactions where rule violations, suspected fraud, technical issues, or legal obligations require such action. Updated Buyer Terms will be published with a revised Effective Date. Questions, complaints, or reports may be submitted through the Contact page.
Mandatory Rights Remain. Nothing in these Buyer Terms excludes or limits mandatory consumer rights, statutory protections, or other legal remedies that cannot be waived or restricted under applicable law.
By purchasing items or participating in auctions on the KOTLYARS platform, buyers acknowledge that they have read, understood, and agreed to these Buyer Terms together with all other applicable KOTLYARS policies.
