Prohibited items policy

This Prohibited Items Policy identifies goods, materials, services, and listings that are prohibited or require prior approval before being offered through the KOTLYARS international marketplace and auction platform.

KOTLYARS is committed to maintaining a lawful, secure, and trustworthy marketplace. Items that present legal, safety, ethical, reputational, or regulatory risks may be prohibited even if they are not specifically listed in this Policy.

This Policy applies to every listing, auction lot, fixed-price offer, photograph, description, document, and other content published on the KOTLYARS platform. It supplements the Terms and Conditions, Seller Terms, Buyer Terms, Auction Rules, and all other applicable KOTLYARS policies.

  1. Application of This Policy. This Policy governs all items and offers published on the KOTLYARS platform. The categories described below are not exhaustive, and KOTLYARS reserves the right to prohibit additional items where necessary to protect users, comply with applicable law, or maintain marketplace integrity.
  2. User Responsibility. Before listing or purchasing an item, users are responsible for determining whether its possession, advertising, sale, transport, export, import, or transfer is lawful in every relevant jurisdiction. Permission in one country does not automatically make an item acceptable on KOTLYARS or lawful elsewhere.
  3. Illegal and Stolen Items. Stolen, unlawfully acquired, smuggled, seized, pledged, fraudulently obtained, or otherwise encumbered property is strictly prohibited. Items connected with criminal activity, disputed ownership, or lacking lawful authority for sale must not be listed.
  4. Counterfeits and Misrepresentation. Counterfeit goods, forged certificates, false hallmarks, fake serial numbers, altered signatures, misleading packaging, and fraudulent documentation are prohibited. Laboratory-grown, synthetic, treated, enhanced, composite, reconstructed, or imitation gemstones may only be listed where their true nature is clearly, accurately, and prominently disclosed.
  5. Dangerous and Recalled Products. Products presenting unacceptable health or safety risks, officially recalled products, radioactive materials, toxic substances, explosives, hazardous chemicals, or other dangerous goods are prohibited. Items lacking legally required safety information or banned by competent authorities may not be listed.
  6. Weapons and Explosives. Firearms, ammunition, explosives, detonators, functional weapon components, and instructions intended for unlawful manufacture or use are prohibited. Antique, ceremonial, or deactivated weapons may only be considered following prior written approval from KOTLYARS together with all legally required documentation.
  7. Drugs and Regulated Substances. Illegal drugs, controlled substances, precursor chemicals, drug paraphernalia, counterfeit medicines, doping products, and materials intended to facilitate unlawful drug use are prohibited. Medicines, medical devices, tobacco, nicotine products, alcohol, and other regulated goods may only be listed if KOTLYARS officially enables the relevant category and applicable legal requirements are satisfied.
  8. Money, Documents and Personal Data. Counterfeit currency, active payment cards, stolen financial instruments, login credentials, cryptographic keys, identity documents, confidential information, personal databases, passwords, and tools intended to bypass identity verification are prohibited unless their sale is expressly authorised by applicable law.
  9. Human Remains and Medical Material. Human remains, organs, tissue, blood, biological samples, embryos, and items containing such material are prohibited. Medical, funerary, archaeological, or religious objects potentially containing biological material require prior approval together with documented evidence of lawful origin and ethical provenance.
  10. Wildlife, Animals and Plants. Live animals, unlawfully collected plants, and products made from protected species—including ivory, rhinoceros horn, tortoiseshell, coral, protected skins, feathers, and similar materials—are prohibited unless all required permits, provenance documentation, and applicable CITES or national authorisations have been verified.
  11. Cultural Property and Archaeology. Illegally excavated, imported, exported, stolen, looted, or unlawfully transferred cultural property, archaeological artefacts, archives, manuscripts, and sacred objects are prohibited. Historically significant objects may require export licences, ownership records, provenance documentation, or other evidence of lawful circulation before being listed.
  12. Gemstones and Diamonds. Gemstones with false origin claims, undisclosed treatments, inaccurate grading, misstated weight, false laboratory reports, or misleading descriptions are prohibited. Rough diamonds may only be traded in compliance with the Kimberley Process Certification Scheme and all applicable legal requirements. Conflict diamonds and false certification are strictly prohibited.
  13. Precious Metals and Jewellery. Items containing false fineness claims, forged hallmarks, concealed plating, inaccurate composition, hidden fillers, unlawfully sourced precious metals, or misleading weight descriptions are prohibited. Required assay reports, certificates, treatment disclosures, and supporting documentation must be provided where required by law or platform policy.
  14. Sanctions and Trade Controls. Listings or transactions involving sanctioned persons, entities, countries, vessels, goods, embargoed destinations, export-controlled products, or restricted technologies are prohibited. Users must not attempt to circumvent sanctions or trade restrictions through intermediaries, undervaluation, rerouting, false documentation, transaction splitting, or concealed ownership.
  15. Intellectual Property. Goods or materials infringing copyright, trademarks, patents, design rights, image rights, or other intellectual property rights are prohibited. Lawful replicas, reproductions, modified items, or replacement components must be accurately identified and must not be presented as original or officially authorised products.
  16. Other Prohibited Categories. Content promoting terrorism, organised crime, violence, hatred, child exploitation, unlawful sexual exploitation, hacking, malware, cybercrime, fraud, or other illegal activity is prohibited. KOTLYARS may also prohibit items incompatible with marketplace values or with the requirements of logistics providers, insurers, payment providers, or commercial partners.
  17. Platform Evasion and Sham Offers. Fictitious listings, advance-fee schemes, investment scams, lotteries, pyramid schemes, listings without genuine intent to sell, advertisements disguised as products, or attempts to bypass KOTLYARS rules or verification procedures are prohibited.
  18. Documents for Regulated Items. Where an item may be lawfully traded subject to regulation rather than absolute prohibition, sellers must provide all licences, permits, certificates, declarations, provenance documentation, and other required evidence before publication. Missing documentation or inability to verify authenticity or legality may result in refusal or removal of the listing.
  19. Detection and Platform Action. KOTLYARS may review listings, consult official databases, request documentation, suspend publication, remove listings, cancel marketplace activity, restrict platform features, suspend accounts, preserve evidence, or cooperate with competent authorities where required by law or necessary to protect users and the marketplace.
  20. Reports, Appeals and Contact. Users may report prohibited items through the Contact page together with supporting evidence and the relevant listing link. Knowingly false, malicious, or abusive reports are prohibited. Sellers may submit explanations, supporting documents, and appeals through the available review procedures. Any seizure, storage, surrender, destruction, or legal disposition of physical items remains governed by applicable law and the rights of the party in possession.
Core Rule. If lawful ownership, provenance, authenticity, legality, safety, transportability, or regulatory compliance cannot be reasonably established, the item must not be listed on the KOTLYARS platform. Any prior review or approval by KOTLYARS does not transfer responsibility away from the seller or reduce the seller's legal obligations.

By listing items on the KOTLYARS platform, sellers acknowledge that they are solely responsible for ensuring every offered item complies with this Prohibited Items Policy, applicable legislation, and all other relevant KOTLYARS marketplace rules.
