Seller terms

These Seller Terms govern the listing, sale, and auction of items offered through the KOTLYARS international marketplace and auction platform. They establish the responsibilities of sellers and define the standards required for lawful, transparent, and trustworthy trading.

Sellers are responsible for the legality of every item offered, the accuracy of every listing, and full compliance with applicable laws and KOTLYARS marketplace policies.

These Terms supplement the general Terms and Conditions, Auction Rules, Prohibited Items Policy, Privacy Policy, and all other applicable KOTLYARS policies. Where mandatory legislation applies, those legal requirements prevail.

  1. Application of These Terms. By creating a seller account, publishing a listing, or participating in a marketplace transaction, the seller agrees to comply with these Seller Terms together with all other applicable KOTLYARS rules and policies.
  2. Seller Status. Sellers must accurately identify whether they are acting as a Trader or a Private Seller. Individuals conducting regular commercial sales as part of a business or professional activity must not present themselves as private sellers. KOTLYARS may display seller status and request supporting documentation where appropriate.
  3. Seller Identification. Sellers must provide accurate legal or personal names, contact information, addresses, and any additional information necessary for operating the marketplace and completing transactions. Business sellers must provide registration, tax, or licensing information where required by applicable law. KOTLYARS may restrict seller functions until required verification has been completed.
  4. Ownership and Authority. Sellers must be the lawful owners of listed items or possess documented authority to sell on behalf of the owner. Items subject to theft, seizure, security interests, contractual restrictions, ownership disputes, or other legal encumbrances must not be listed. Upon request, sellers must provide evidence supporting ownership, provenance, inheritance, purchase, or other lawful authority.
  5. Permitted and Prohibited Items. Before publishing a listing, sellers must determine whether the item is permitted under both applicable law and the KOTLYARS Prohibited Items Policy. Illegal, counterfeit, unsafe, sanctioned, or otherwise prohibited goods must never be listed. KOTLYARS may remove listings and restrict seller accounts where legitimate concerns exist regarding legality or compliance.
  6. Listing Accuracy. Sellers must provide accurate, complete, and understandable descriptions of every item offered for sale. Listings should disclose dimensions, weight, materials, condition, defects, repairs, alterations, included accessories, provenance, and every other material characteristic relevant to a buyer's decision. Photographs must accurately depict the actual item and must not conceal defects through editing or misleading presentation.
  7. Certificates, Provenance and Authenticity. Where available, sellers must disclose certificates, laboratory reports, expert opinions, provenance records, and other supporting documentation relating to gemstones, jewellery, precious metals, artwork, and other valuable property. Sellers remain solely responsible for the authenticity of all documents and all statements relating to origin, authorship, age, specifications, treatment, provenance, and value. Where certificates or permits are mandatory, items must not be published before the required documentation has been provided.
  8. Price, Currency, Fees and Taxes. Sellers determine the fixed price or auction settings and must clearly identify the transaction currency together with any mandatory costs payable by the buyer. Sellers remain responsible for their own taxes, registrations, customs obligations, reporting requirements, and other legal responsibilities arising from the sale. Any KOTLYARS platform fees apply only where published in advance or agreed separately.
  9. Fixed-Price Sales. Sellers should promptly confirm item availability and agree with buyers on the purchase price, payment arrangements, delivery method, insurance, transfer procedure, and return conditions. Once a transaction has been confirmed, sellers are expected to complete it according to the published listing and any agreed contractual terms. Unique items should not be offered simultaneously to multiple buyers after a sale has been confirmed.
  10. Auction Sales. Sellers must comply with the KOTLYARS Auction Rules and accurately specify the auction period, lot description, starting price, reserve price, bid increments, and applicable fees. Sellers must not bid on their own listings, use associated persons to manipulate auction prices, or engage in any conduct that artificially influences auction outcomes. Following a successful auction, sellers must act in good faith and complete the transaction with the winning bidder where auction conditions have been satisfied.
  11. Payment. As of the Effective Date, KOTLYARS does not receive, process, or hold user payments. Buyers and sellers independently agree on payment arrangements. Sellers must provide accurate payment instructions, confirm receipt of funds where appropriate, and issue invoices or other legally required documentation. Payment methods intended to evade applicable law or platform rules are prohibited.
  12. Delivery, Packaging and Insurance. Before the transaction is completed, sellers must clearly disclose available delivery methods, shipping costs, expected dispatch times, insurance arrangements, and any delivery restrictions. Items should be securely packaged, appropriately insured where necessary, and transferred using suitable delivery services. Unless otherwise agreed or required by law, sellers remain responsible for proper dispatch and delivery.
  13. Returns, Guarantees and Buyer Service. Sellers must publish clear policies regarding cancellations, returns, refunds, warranties, and guarantees. Traders remain responsible for complying with mandatory consumer protection legislation, including distance-selling rights, statutory guarantees, and legal remedies. Private Sellers must also comply with agreed contractual terms and may not exclude liability arising from fraud or deliberate misrepresentation.
  14. Complaints and Disputes. Sellers should respond promptly to reasonable buyer enquiries and complaints and retain transaction records, correspondence, payment confirmations, shipping documents, and supporting evidence. Buyers and sellers should first attempt to resolve disputes directly. KOTLYARS may facilitate communication or review compliance with platform rules but is not obliged to issue legally binding decisions.
  15. Law, Sanctions, Import and Export. Sellers must comply with all applicable legislation concerning trade, taxation, consumer protection, anti-money laundering, sanctions, cultural property, export controls, import regulations, customs requirements, and related legal obligations. Required licences, permits, declarations, and supporting documents remain the seller's responsibility. KOTLYARS may request additional information, suspend transactions, or cooperate with competent authorities where legally required.
  16. Rights in Listing Materials. Sellers retain ownership of photographs, descriptions, documents, and other content they lawfully own. By uploading content to the platform, sellers grant KOTLYARS a non-exclusive, worldwide, royalty-free licence to store, reproduce, translate, format, display, distribute, and promote that content for operating and marketing the marketplace. Sellers warrant that their content does not infringe copyright, trademarks, image rights, or any other third-party intellectual property rights.
  17. Platform Review and Enforcement. KOTLYARS may review seller accounts, listings, supporting documents, marketplace activity, and complaints. The platform may request corrections, suspend publication, remove listings, cancel marketplace activity, restrict account functions, or permanently close seller accounts where necessary to address rule violations, suspected fraud, safety concerns, technical errors, or legal obligations.
  18. Updates and Contact. Updated versions of these Seller Terms will be published together with a revised Effective Date. Questions, verification requests, complaints, or reports concerning seller activity may be submitted through the Contact page.
Seller's Core Responsibility. Every seller remains fully responsible for the legality of each item offered, the legal authority to sell it, the accuracy of every listing, the authenticity of all supporting documents, compliance with taxation and regulatory requirements, proper completion of every transaction, and respect for all mandatory buyer rights established by applicable law.

By creating listings and offering items for sale through KOTLYARS, sellers acknowledge that they have read, understood, and agree to comply with these Seller Terms together with all other applicable KOTLYARS marketplace policies.
